The Toxic Tide: AFFF Lawsuits and the Wave of Environmental Litigation

by Clare Leave a Comment

PFAS, a class of synthetic chemicals, has been widely used in various industries, including food packaging, textiles, and electronics. Although they are valued for their durability and resistance to heat, water, and oil, PFAS have been associated with harmful health effects such as developmental problems.

According to the Agency for Toxic Substances and Disease Registry, human research shows that high levels of particular PFAS may cause elevated cholesterol, impaired vaccination response in children, an increased risk of cancer, and changes in liver enzymes.

This article will explore the issue of AFFF lawsuits, the impact of PFAS contamination, and the wave of environmental litigation that has followed.

The Relation Between AFFF and PFAS

Aqueous Film-Forming Foam, or AFFF, is a specially formulated firefighting foam that has been used for many years by firefighters to extinguish fires involving flammable liquids like gasoline, oil, and jet fuel. AFFF works by forming a blanket of foam over the fuel, which separates the fuel from the oxygen in the air, effectively smothering the fire.

PFAS, or perfluoroalkyl substances, are a class of man-made compounds found in a variety of industrial and consumer goods, including AFFF. The property of PFAS to resist water and oil makes them excellent for use in firefighting foams. PFAS, on the other hand, are exceedingly persistent in the environment and do not degrade quickly, giving them the moniker “forever chemicals.”

One of the most serious issues about PFAS is that they can accumulate in the environment as well as in the bodies of animals and people. PFAS exposure has been linked to a variety of health conditions, including cancer, damage to the liver, and developmental disorders, according to research. PFAS have also been linked to reproductive and immune system problems.

Researchers from the Icahn School of Medicine at Mount Sinai in the US have led a new study that has found a significant association between higher blood concentrations of perfluoroalkyl substances and a reduction in the likelihood of pregnancy and live birth among a group of women in Singapore who were attempting to conceive.

AFFF Lawsuits

AFFF lawsuits have been on the rise in recent years, with thousands of plaintiffs alleging that exposure to AFFF and its PFAS components have caused them serious health issues. The lawsuits have targeted various parties, including manufacturers of AFFF and PFAS, as well as municipalities and the federal government for their use and handling of AFFF.

Many law firms are now involved in AFFF lawsuits, representing plaintiffs who have been impacted by the use of AFFF and the resulting PFAS contamination. These law firms specialize in environmental law, toxic torts, and personal injury cases and have experience representing clients who have suffered from exposure to harmful chemicals.

Some law firms like TorHoerman Law, LLC have even formed dedicated teams to handle AFFF cases, with attorneys who have knowledge of the science behind PFAS contamination and the legal strategies necessary to hold the responsible parties accountable. These teams remain informed on any AFFF lawsuit update that comes out and works closely with experts in fields such as epidemiology and toxicology.

Other law firms are also actively involved in AFFF cases, and the number of lawsuits is expected to continue to rise in the coming months and years. As more information comes to light about the dangers of PFAS exposure, it is likely that there will be increased scrutiny on the use and handling of AFFF and other products containing these harmful chemicals.

The Wave of Environmental Litigation

The rise of AFFF lawsuits is just one example of the wave of environmental litigation that is sweeping the nation. As awareness of the impact of PFAS contamination and other environmental issues has grown, plaintiffs have increasingly turned to the courts to seek justice and compensation.

The Lawsuit Information Center has reported that as of the latest updates, there are 4,058 pending AFFF cancer lawsuits in the firefighting foam class action. It is widely speculated that a potential global settlement deal is being considered for these AFFF lawsuits.

Environmental litigation covers a wide range of issues, including pollution, hazardous waste, and climate change. Lawsuits can target various parties, including companies responsible for environmental damage and government agencies that have failed to regulate or address environmental risks.

The rise in environmental litigation has serious consequences for businesses, governments, and individuals. Companies that fail to take environmental risks seriously may face significant legal and financial consequences. Governments that do not adequately regulate environmental risks may be held accountable in court. Individuals who have been impacted by environmental risks may have a path to justice and compensation through the courts.

Conclusion

In conclusion, the rise of AFFF lawsuits and the wave of environmental litigation highlights the growing awareness and concern regarding the impact of man-made chemicals on our health and the environment. The use of PFAS in AFFF has resulted in serious health and environmental risks, and plaintiffs are increasingly turning to the courts to seek justice and compensation.

This has enormous consequences for companies, governments, and individuals, emphasizing the need for more accountability and responsibility in dealing with environmental concerns. As more information emerges about the dangers of PFAS and other harmful chemicals, it is likely that the trend of environmental litigation will continue to grow in the coming years.
